Abstract

The present paper aims to provide a brief analysis of off-plan sale and purchase transactions, discussing the issues that may arise in relation to their essential elements, particularly regarding their formal aspects and the transfer of ownership, while proposing possible solutions to enhance purchaser protection. It also offers a concise examination of the statutory guarantees established for such cases, seeking to analyse some of their most common practical issues in light of both lower-court case law and the jurisprudence of the Spanish Supreme Court.
